    Documents are usually lost and replaced (via duplicates).

    Just ensure that you scan the docs into PDFs or something like that (Most of the new home printers have this option). When a need comes, just print the PDF.

    Hello All,

    One of my friends mentioned that there is a possibility that I-94 card could be stamped with the date on my current visa stamp at the port of entry. This would invalidate my wife's transfer since the new transferred visa is valid until 2009 whereas my stamping with my old employer is valid only until Dec 2007. In order to avoid this, should my wife submit her passport as well as the I-797 and I-539 from my current employer and ask the officer to stamp the new dates on the I-94? Please advise.

    It would not invalidate the transfer, as legally there is no such thing as transfer it is always a new H1/4 what she loses is her extension period on I-94 and you will be forced to file an extension for her an unnecessary hassel. Usually if H1/4 travel together this problem rarely happens as the H4 spouse is automatically given same I-94 time as H1 per their new I-797. But some VO's surprise are still too new at their job to figure out the same for H4 travelling alone.

    AC21 letter can be sent to USCIS, but as everyone says its not a must.

    AC21 letter is a MUST if I-140 was revoked by the previous employer. There are cases where USCIS had mistakenly denied I-485's with revoked I-140's in spite of submitting AC21 papers.

    In such situations, the only life saver in MTR (Motion to Re-appeal) is the proof of submitting AC21 papers on time.

    The icons can all be found here: C:\Program Files (x86)\Microsoft SDKs\Windows Phone\v7.0\Icons

    You can just drag and drop the icon you want into Blend or explicitly add it via the Projects panel :)

    Your question on connecting to an XML data source is interesting because there are several ways of doing this. One approach is by using Linq and just parsing the output.

    I wanted to see if I can write a simple application that uses a dictionary API to query a server somewhere (if I said that right). I have some ideas for a few more difficult apps so I wanted to start with this simple one.

    I�m mostly using Expression Blend to create these apps.

    The first thing I would like to know is:
    * How do I use a wp7 icon (from the icon pack) as a clickable button? I have an input search TextBox, but instead of using a simple button control (for the click event) I would like to use the magnifying glass icon as the search button --something similar to how Bing (on WP7) uses the mic in the search box. How can I accomplish this?

    * How is an API use in app? I found a few APIs/ RSS feeds and XML data sources that I would like to utilize in my future apps, but I�m not sure how to implement them.

    I believe the same post sounds some what fishy, check this guys posts all the way back from 07 to till now.

    USCIS going all the way back to 1999, that too dependent's I-94 card which has a month expired.

    Why on earth an attorney didn't suggested to use nunc pro trunc which facilitates saying person is maintaining legal status after the recent entry.

    What is your problem mister? What will a person get here to post a fishy message? If you can not offer any help then it is better to read and ignore. Instead of hurting someones feeling. I guess you do not understand how does it feel when some one tells you " you will be thrown out from this country with in few days after spending 10 yrs here".

    Any way Good luck to you for your GC!!! and I wish that you will not face this kind of pain of rejection.

    Though, I'm really sorry to see such kind of arrogant and bad-mouth people in this forum.

    Hi,

    After reading about the pro's and cons of EAD e-file and paper based. I found that when you paper file I765, you DONOT get a fingerprinting notice and you DONT need to give FP. You will get your EAD directly. With e-file you dont send in the photos but u will have to go do the fingerprints and photo taken..

    Can anyone confirm this?

    My employer has not provided copy of labor or I-140.

    I am not planning to use AC-21 as my employer and work profile is good. But say if there is some thing unplanned happens, and if I need to change jobs, what can I do?

    not having copy of labor or I-140 is an issue for AC21?

    Does the cover-letter you included while filing your 485 include your job duties?
    thats basically what you need, to make sure your new duties/position are inline with what was decribed in the LC.

    Hi,

    I just got my 2nd 3 year extension (Nov 2006 to Nov 2009) on my H1B after completing six years.

    My PD is June 2005 and I-140 approved on July 2006. I am thinking of
    changing my job. I am puzzling about the following questions:

    1. Can I change the job and use my 3 year extension for the next job?
    2. Can I keep my PD of June 2005 if my current employer doesn't revoke
    my I-140 ?
    3. If I apply for GC again with new employer and get my I-140 approved , can
    I keep getting 3 year extensions on that job ?

    PLEASE HELP!.

    Is this in RFE connection with an Adjustment of Status filing? if so, you really only need to show that you did not violate status for over 180 days since your last lawful entry (Section 245(k) of the Immigration and Nationality Act).

    In any event, proving that you maintained status does not require showing all old I-94s. You need to show that you were approved for or admitted in a certain status, and that you stayed in that status until it was changed or extended. Approval notices, visas, and maybe entry stamps from your passport re usually enough, and just the most recent I-94. If you held F-1 status, you would need to show your I-20s, visa and proof that you maintained a full courseload as required by the I-20.

    My question was not related to any RFE in specific. But in a general way, what would be the procedure to obtain the past copies of I-94's.

    As per your answer, it should not matter, If I have the copies or not. It would be good, if we have it. Otherwise there are alternative ways to answer the RFE.

    Hello,

    I am currently working as full time and planning to move to consulting. I have the below questions

    (i) I know its a bit risky to move to consulting right now compared to Fulltime, but still i See the H1 petetions for most of consutling companies are getting approved.
    Do you think is it OK to move to consulting from Full time?

    (ii)As client letter is mandatory these dayz, whats the best approach to apply for transfer? Like e finding the project and proceed for premium processing

    1 - Start preparing resume
    2 - Post it on job posting sites
    3 - You will get lot of calls if your skills are in demand.
    4 -If you know any consultancy talk to them regarding your H1.
    5 - They will say your H1 will be filed once you get the project. Talk about the terms.
    6 - As soon as you get the project ask your employer to file labor.
    7 - Tell interviewer you need two weeks notice.This will give time to file H1
    8 - Within two weeks your employer shoul file your H1.
    9 - As soon as you get your receipt number, join the client to work.

    Pretty simple right. If your target is to get green card, Do not think about anything else, you will get scared.

    This is a very genuine concern. I being the only son have worries on the same lines too. Although my parents are healthy and doing fine at this time but I get really get tensed to fathom what is there down the line in another 5 years or so. Bringing them here is not an option, medical insurance will not cover pre-existing condition neither is there any visa other than B2. Two options come to my mind:

    1) I take up job which requires lot of travel, back-and-forth to India.
    2) I move for good to India.
    3) Look for a full-time nurse to be available to take care of them and I travel to India once in every 3 months, may be just for a week or so each time.

    All three options put a dent in your life. But I guess the golden period of life is over, remaining period of life will go raising your kids, looking after your parents. Sometimes I like the American culture a lot; you get to enjoy all life long!

    This happens from time to time dont know why but it happens.It happened for my wife too , we had efiled for EAD and her application status showed that notice(FP) returned as undeliverable. My wife wrote back to USCIS
    saying that she had received all her prior communication from USCIS here
    (for example we put in copies of 485 recipt notice,485 FP notice,EAD recipt notice) and it seems to a mistake of USPS. She also wrote to the Local Postmaster as to why the notice from USCIS was returned and in future all this should not reoccur. Within a day or two we got her EAD approved and recieved it in mail.
    The point I am trying to make is that calling(it might not be the best option as lines are busy,reps dont have the info you would like etc) as well as writing does help when u know the where to send mail , we were lucky as we had efiled so it does specify where to send the application and docs .Good Luck.

    In my case just now I called up again with POJ method got hold of nice IO. She took her own time to dig out all teh information rleated to my case and saught confirmation on many things like address name etc. After few minutes she said dont worry about the online status my case is assigned to officer. I hope whatever the outcome will be good.
