    Guys,

    I had to open a new thread to get your attention to this. But it seems that the House Stimulus Bill passed this evening contains the 'E-Verify' . Incidently, when Sen. Menendez introduced the Visa Recapture Bill last year, he held the republican's at bay by not passing E-verify in the senate. If, E-verify is passed in the senate, then we will loose an important bargaining chip for visa recapture bill of any kind. Please read the info. below. You can also google e-verify house stimulus bill to get the latest.

    Action step is to strip e-verify from the Senate Stimulus bill. Please see below.

    The House Appropriations Committee made a serious mistake when it approved an amendment to the stimulus bill (the American Recovery and Reinvestment Act of 2009) that would require all businesses and other public or private �entities� that contract to receive money from the stimulus package to use the flawed federal Basic Pilot/E-Verify program. This will not only delay use of stimulus funds, but will hurt millions of workers. It should be stripped from the bill.

    The E-Verify provision in the stimulus will:
    � Harm workers who are either falsely denied work or are targeted by employers abusing the E-verify program;
    � Create substantial new burdens for businesses, especially small businesses, at precisely the wrong time;
    � Send the wrong signal to new voters that the Congress prefers to play politics by enacting symbolic and ineffective immigration �enforcement� measures over serious and effective economic stimulus or serious immigration reform.

    ACTION NEEDED

    1. Call Speaker Nancy Pelosi (head of Democratic Leadership) at 202-225-0100.

    2. Call Chairman Obey (chair of the House Appropriations committee) at 202-225-3365.

    3. Call Democrats who sit on the appropriations committee if you live in their state.

    4. Tell them:
    � You are extremely disappointed that the E-Verify requirement was included on the Stimulus and you want the provision stripped from the bill.
    � Including E-verify in the stimulus package completely undercuts the purpose of the bill and will only be counterproductive for American business, workers and the economy.
    � Real solutions to our economic problems and immigration reform should be approached seriously and separately.
    � The flawed E-Verify program�s database errors will wrongly workers their jobs.

    FAIR (the Federation for American Immigration Reform) just sent out an alert to its very active network to call committee members in support of this provision. We need to counter their calls.

    We did not return the i94 while traveling by air - and our renewal notice was with i94 (same number)

    We received the RFE letter on my pending I-140.

    I am not sure what they are looking for. We had submitted letters of experience prior to Dec 2004 that added up to 1 year. Basically, I worked with 2 companies during that time.

    Initially I had sent:
    a. 1 letter from Company A
    States my title, skills dates
    b. 2 letters from Company B.
    1 generic letter from HR stating dates, no skills
    1 letter from colleague stating title, skills, dates

    Here's the RFE details. The lawyer is not sure what to do. He says we will simply resend the letters. I don't know if that's a good idea. Can anyone please help?

Evidence of experience must be in the form of letters from current or former employers giving the name, address and the title of the employer and a description of the experience of the beneficiary including specific dates of employment or duties.

    Please note that the petitioners statement of the beneficiarys prior employment is insufficient evidence. A letter of reference must be written by the employer from whom the beneficiary was employed and obtained experience in the job offered prior to December 25, 2004. Such references must be submitted to cover twelve months.

    Now that H.R 5582 has cleared Judiciary sub - commitee and moves to Judiciary Full Commitee, I think we all need to focus our "Call/Fax" campaign and overwhelm the fence sitters with calls etc .

    1. At Full judiciary commitee the list of congressman would be more than 10-15 .Probably 30-40??. Size wise it might be prohibitive.

    2 No point in 1000 of us calling Steve Kings ....He will never change his mind . Spare this effort to convince fence sitters instead. No point in calling the one who we know already support either.

    This leaves us with plenty of time to repeatedly call the fence sitters and force them to jump our way

    Hello friends,
    On May 01,2009 my wife's I-485 status changed online that they requested additinal evidence. I have not received RFE letter as of now and also I am touch base with my attorney, my attorney's office also not received RFE letter. Please advice me what steps I have to take in this regard.
    Please provide all your GC personal details in IV so that you will get better answers.

    I think timesofindia has a right to report news. They are not a lobby group ..they are a newspaper. Give them a break.

    Although I do agree It is a poor quality newspaper, You can clearly see cheap shots on its main webpage.and the news selection for headlines is extremly british tabloid kind...flashy and worthless .

    They also run "economictimes" for business news, which is considered premier business newspaper in india... I feel really disappointed when
    I compare its quality with "wall street journal" or "businessweek".

    The attorney informed us that both our EAD's were received today.

    The point here is the original ead expiry date was 10/15/2008. The new EAD expiry is 07/15/2010 and not 10/14/2010.

    Its validity is not 2 years from the original expiry but 2 years from the current approval date.

    Are others getting it the same way?

    My friend went to Boston Airport ->Immigration/custom Office next day for correction. His father came on B1 visa but they put wrong month on I-94. That office corrected that immediatly. There must be something at every international airport.

    Which state are you from? Do they insist on Passport? In NC, if you have a valid drivers licence, all you need is a valid I797. They don't insist on the passport.

    This is true at least as of Oct/nov 2010.

    As the other member said, I have had no luch with phone/email from our embassy. Going in person "may" help, but since you mailed your application, they processing may be different.

    Also sorry for another question as I forgot to mention this earlier.

    My new H1B has more than 6 months of validity period.

    One thing which I forgot to mention earlier is that when new Employer "B" did the H1B transfer (June 2007) from Employer "A" - the I-797 receipt # of Employer "B" came out of to be different from I-797 receipt # of Employer "A"?
    Shouldn't the I-797 receipt #'s for Employer "A" and Employer "B" should be SAME as it's just an H1B transfer???

    Employer "A" I-797 receipt #:
    EAC - XXX-XXXX
    I-797 valid : 0ct' 2009

    Employer "B" I-797 receipt #:
    WAC - XXX-XXXX
    I-797 valid: June' 2010

    As I-797 receipt # gets printed on the H1B visa in the Passport, does having a different I-797 receipt # (of Employer "B") affects anything at port of entry?

    Of course the receipt number would be different, because each H1 application is treated as a new application, regardless of whether its a transfer or new. So, they are identified uniquely.

    No, at port of entry, you show the new H1 and you get the new I-94 with an expiry date that's on the H1...which would be June 2010. Remember, The I-94 (Arrival-Departure Record) shows the date you arrived in the United States and the “Admitted Until” date—that is the day your authorized period of stay expires, usually its the expiry date what's on your H1.

    So, even though your visa may expire after some time, you are legal to stay till the date mentioned on the I-94. I hope its clear to you.

    I am going to Canada tomorrow for my H-1 stamping. My passport expires in Jan 2008 though (less than a year left!!). I assume that I will get a 3-year visa stamp.
    However, when I re-enter the US, I guess the I-94 I get will have an expiration date that matches my passport expiration date rather than my H1B visa expiration date. Am I correct in assuming this?
    Is there such a thing as an I-94 extension, and if so how easily does it get approved. Thank you so much, but I am getting really worried right now.
    You can always file for visa extension again...never heard of a I-94 extension as such....I think they might give you a proper I-94 for the whole valid duration...Anyway you can get a new passport booklet in US from consulate fairly quickly...

    I am also in the same boat. I am Aug 2007 filer. I got an interview at local office on Feb 2009 to check on my vaccination papers.. They told me my papers will be at their office until the dates become current, and that they will issue Finger print notice before apprving the case(when the date become current) that as my FP was close to expiry then. They gave me a letter that said only contact them 30 days after the dates become current. I havent got the FP notice yet. Not sure if I should contact the local office.

    is OP wrong or right in his assumption?

    Personally, I don't think it matters whether an applicant is direct employee or works for a consulting company. If it was indeed true, then people would start jumping on the direct client bandwagons :D

    how would uscis have the ability to decode between a direct hire and a non direct hire application?

    abc corporation is abc corporation. what OP was implying was that employees at companies with well established brand names would get it faster. but there are thousands of legitimate companies in various fields other than software that have 0 brand recognition outside their industry.

    Dear All,

    Could you please advise, if we can port eb3 to eb2.

    My husband is working for the same employer for last 6 years. He has masters degree from US and he filed for his GC in 2004. In 2004, he had only 1 year experience. The lawyer said he does not qualify for Eb2 despite his US degree.

    Now after 6 years, he had a job change within his company. He became a principal engineer from just an engineer. Could we port to EB2?

    If yes, what should we be careful about and how should we go about it?

    what do u mean by approved labor not signed??

    Labour approval is approved by DOL .
    It needs to be attached to 140 application.
    140 application needs to signed by employer or by attorney in case a G 28 is signed by the employer.
    485 is to signed by you or by attrnoney in case a G 28 is signed by you

    That is correct. You do not get to sign the 140 as it is has to be applied by the employer. You however, have to sign your approved Labor which will be attached to the 140 application.
